Nursing Home Liability

Typically, claims against nursing homes arise when an individual suffers an injury while a resident of the nursing home. They have a right to bring a claim against the nursing home.

Nursing homes do not just provide a place to live. The employees of nursing homes are responsible for the care, treatment and assistance of its residents. Nursing homes are paid to assist their residents in their daily activities and needs.

Oftentimes, residents of nursing homes are unable to care for themselves. They depend upon the nursing home staff to assist in meals, bathroom needs and walking. The families of the residents should always monitor the health and well-being of their loved ones.

Long-term care patients in hospitals are in a similar situation. Often, these patients must rely upon the hospital’s staff to aid in daily activities. Patients who are injured while under the hospital’s care have a right to bring a claim against the hospital.
